Terms of Service

Eligibility

You must be at least 18 years old (or the age of majority where you live) to use Marked. Body-modification procedures may have additional legal age and consent requirements where you live.

What Marked is (and isn’t)

Marked helps customers find artists and request appointments. We do not provide tattoo, piercing, or other body-modification services, and we are not a party to the agreement between you and an artist.

Artists are solely responsible for the services they offer, their licensing and compliance, and the safety and outcome of their work.

Your account

Provide accurate information and keep your login credentials secure. You are responsible for activity under your account. Enabling two-factor authentication is recommended.

Bookings and deposits

Booking through Marked sends a request to the artist, which they may confirm, decline, or cancel.

An artist may require a deposit to hold a booking. Deposits are charged at the time of booking and are non-refundable unless the artist states otherwise or the law requires it.

Appointment times, pricing, and policies are set by the artist. Please review them before booking.

Payments

Payments and deposits are processed by Stripe. By paying, you authorize the charge and agree to Stripe’s terms.

Artists receive funds through Stripe Connect. Marked may charge a platform fee on transactions; any such fee is reflected at checkout or in your artist payout.

Artist responsibilities

If you list as an artist, you agree that your services, prices, availability, and credentials are accurate, that you hold any required licenses, and that you comply with all applicable laws and health/safety regulations.

Acceptable use

Do not use Marked for unlawful, fraudulent, harassing, or infringing activity, and do not attempt to disrupt or gain unauthorized access to the service.

Your content

You keep ownership of content you submit (such as profile details and portfolio photos). You grant Marked a non-exclusive license to host and display that content for the purpose of operating the app, and you confirm you have the rights to share it.

Disclaimers

The app is provided “as is” without warranties of any kind. Marked does not guarantee the quality, safety, legality, or outcome of any artist’s services, or that listings are accurate or available.

Limitation of liability

To the maximum extent permitted by law, Marked is not liable for any indirect, incidental, or consequential damages, or for the acts, omissions, or services of any artist or shop.

Deleting your account

You can permanently delete your account at any time from Account Settings → Delete account. Deletion is irreversible.

Before your account is deleted, we settle any money in flight: held deposits are refunded and upcoming bookings are cancelled. If you are an artist, deposits you have already earned are released to your payout account where possible.

We then remove your personal details and disable your login. Some records are kept in a de-identified form — past bookings, quotes, and care messages remain available to the other party involved, and payment/transaction records are retained — as needed to honour the other person’s records and to meet legal, tax, and financial-compliance obligations. Termination

You may stop using Marked and delete your account (see above) at any time. We may suspend or terminate access if these Terms are violated.

Changes to these Terms

We may update these Terms from time to time. Continued use after an update means you accept the revised Terms.

Governing law

These Terms are governed by the laws of [your jurisdiction], without regard to conflict-of-laws rules.
